Jeff Polsky to Testify Before the California Assembly Judiciary Committee

Jeff Polsky has been invited to testify before the California Assembly Judiciary Committee on March 16, 2004. The topic will be pending California legislation (Assembly Bill 1912) to protect employers who provide substantive information in response to reference inquiries about current and former employees. The bill would create a presumption that employers providing this information are acting in good faith. The presumption could only be overcome by clear and convincing evidence that the employer knew the information was false or acted with intentional malice. Those of you wishing to communicate with Jeff in advance of his testimony are encouraged to do so. He would be particularly interested in hearing from you concerning situations in which your companies or clients have been harmed by being unable to obtain substantive information about job candidates. Of course, he would not identify you or your companies in his testimony. As Jeff explains, "My goal is to convince the committee members that this is a serious problem. It is unfair to subject employers to liability for their employees' conduct while preventing them from obtaining information they need to fairly evaluate candidates."
