OFCCP Posts FAQ on “Internet Applicant” Rule

On November 10, 2005, we reported that the Office of Federal Contract Compliance Programs (“OFCCP”), a federal agency which is part of the U.S. Department of Labor’s Employment Standards Administration, has issued rules regarding the circumstances under which individuals who apply for employment with government contractors using the Internet and/or “related electronic technologies” should be considered to be an “applicant” for a government contractor’s record keeping purposes. See /articles-348.html

The OFCCP has now posted on its website a series of frequently asked questions regarding its rule on the definition of “Internet Applicant” and corresponding recordkeeping requirements. All federal contractors should review these questions and the answers provided by the OFCCP.
