Erica E. Frank
Erica joined KM&M as an associate in 2011 and became a partner in 2019. Over the course of her career, Erica has represented a wide variety of employers with respect to all aspects of labor and employment law.
Erica’s labor relations experience includes leading collective bargaining negotiations, advising and counseling clients on the administration of collective bargaining agreements and the avoidance of unfair labor practice charges, responding to union organizing campaigns and representation petitions, and training managers and supervisors on best practices for working in a unionized environment. She has represented clients before the National Labor Relations Board and at grievance arbitrations.
Erica also advises clients on a diverse array of employment law matters, including counseling on antidiscrimination and antiharassment policies, federal and state leave laws, employment and separation agreements, and restrictive covenants. In addition to litigating employment matters before federal and state courts and in private employment arbitrations, Erica routinely defends clients in front of administrative agencies, such as the EEOC, the New York State Division of Human Rights and OSHA.
Prior to joining KM&M in 2011, Erica was an associate in the Employment and Employee Benefits Department at Schulte Roth & Zabel LLP, where she focused on representing employers as well as high-level executives with respect to employment litigation and counseling, employment agreements, employee handbooks and policies, executive compensation, and employee benefit matters.
Erica earned a Bachelor of Arts in Government from Cornell University’s College of Arts and Sciences in 2003, where she was Phi Beta Kappa. She received her J.D., with honors, from New York University School of Law in 2007, where she was an Executive Editor for the Journal of Legislation and Public Policy.
