Reminder: H-1B Visa Lottery Registration to Open in March

The US Citizenship and Immigration Services (USCIS) will open registration for its annual H-1B visa lottery in March. While we are still waiting for the announcement of exact dates and additional details, now is the time to contact your KM&M attorney if you are considering entering an applicant in this year’s lottery. The registration fee has been increased to $215 per beneficiary.

As a reminder, H-1B workers who need to extend their stay or change employers, as well as individuals who will work for a “cap-exempt employer” (which includes institutions of higher education and certain nonprofit related entities, nonprofit research organizations and government research organizations) are not subject to the H-1B “cap” and therefore do not have to enter the lottery. There are also special rules for applicants who will work concurrently for “cap exempt” and “cap subject” employers.
