Overview

Elizabeth O'Leary joined KM&M as Senior Counsel in January 2011 and became a partner in 2013. Elizabeth practices primarily in the area of employee benefits law. 

She represents trustees of multiemployer pension and welfare benefit plans, and counsels trustees on a wide variety of issues, including ERISA compliance, plan administration, withdrawal liability, delinquency collection, benefit claims and fiduciary issues.  In addition to compliance work, Elizabeth has litigated ERISA claims in federal courts.

Prior to joining KM&M, Elizabeth was a partner at Cohen, Weiss and Simon LLP.  She began her legal career as a law clerk at the New York Court of Appeals.

Elizabeth served on the Professionals Committee of the International Foundation of Employee Benefit Plans from 2016 to 2018 and from 2020 to 2021.

Elizabeth received an undergraduate degree in industrial relations from Le Moyne College in 1991, and a master’s degree from Cornell University’s School of Industrial and Labor Relations in 1993.  She graduated from Cornell Law School in 1996.
